Legal Issues

Star Wars copyright

Ainsworth worked on the props team to help create the stormtrooper helmet. He then went on to make his own in a workshop and managed to sell 19 of these helmets to the US, as did Lucas. This legal battle was between George Lucas and Andrew Ainsworth. George Lucas claimed that Ainsworth shouldn't be making money off of his film by creating and selling the Star Wars helmet/mask and attempted to sue him for doing this, however, he was unsuccessful... Despite the fact that Ainsworth didn't lose this legal battle, he still lost 700,000 fighting the movie moguls. The winner of the case was Ainsworth.

Intellectual Property Law

Most businesses rely on bright ideas including a new product, new brand or new designs.
The intellectual property law is split into 4 different areas: Trade marks, Copyright, Design rights and Patents.

Trade Marks - Trade marks are used by businesses to protect their brands. you can register a trademark in the uk, across Europe or in other countries. You can apply a trademark to a name, a logo or both.  Trademarks need renewing every 10 years.

Copyright - Copyright is associated with images, maps, documents and websites. It's automatically copyrighted meaning its free. Your copyright will last up to 70 years after your lifetime. If you pay someone else to create something for you, they will own the copyright unless its specifically transferred in writing through a contract.

Design rights -  If someone buys your products because of the way it looks then you need to think about design rights. Registered design rights covers the UK and abroad and it's not expensive. Even if you don't register your designs, you can still have automatic unregistered design rights.

Patents - If you invent a new product, process or project then you need to think about patents. Patents can last for up to 20 years. Patents can be an expensive and complicated process. It can be seen being a good investment for the business so they need to seek proper, professional advice.

Data Protection Act

It's a Uk law that makes sure you must follow these 8 principles. Each week we would've had 4000 pieces of information collected about us. Customidata is the life blood of every business on the planet.  The DPA states that personal information needs to be collected fairly and securely.

- Requires consent
- Should only be kept for the reason it was collected.
- Should be kept accurate
- Should be kept up to date
- Should only be kept for as long as it is needed
- Should be made available to us
- Should be process securely
- Should be processed within the Uk
